You were at work when it happened: You fell off the scaffold and hit your head when you landed below. You suffered a head injury, and now you need months or years of recovery and rehabilitation.
Do all employers have workers’ compensation?
Fortunately, New Hampshire requires most employers to carry workers’ compensation insurance. This insurance helps protect all employees no matter whose fault the accident was. Even undocumented workers have access to these benefits if they get hurt on the job.
After you get hurt on the job, you need to seek emergency medical care. Your employer should report the injury if you have to go to the hospital, as required by law. After your initial treatment, you do have the right to choose your own doctor. You can also ask for a second opinion if you’re unsure about the choices of the first health care provider. If your workers’ compensation carrier has managed care, then you can look at a list of providers and choose one from that list.
What happens if a claim is denied by the workers’ compensation carrier?
In the majority of cases, workers’ compensation claims are approved without a problem. In some cases, there are arguments about the validity of a claim. That can lead to your claim being denied.
If your claim is denied, you don’t need to take that as the final answer. You have the right to appeal that decision. Your attorney may be able to help you resubmit the claim with more information and help represent you at a hearing before administrative officers.
